1. Practitioner-only supply

Panaxea products are supplied on a practitioner-only basis and are intended for use under the guidance of qualified healthcare practitioners.

Access to product information, ordering and supply through panaxea.com.au is intended only for registered practitioner customers.

Panaxea products are not sold directly to the general public through this website. Consumers should consult their qualified healthcare practitioner for advice about product suitability, dosage and use.

2. Practitioner responsibility

Practitioner customers are responsible for assessing whether a product is suitable for their patient or client, including consideration of individual health circumstances, current medicines, supplements, pregnancy or breastfeeding status, allergies, contraindications and relevant clinical factors.

BlueSkyGreenEarth Herbs Pty Ltd does not provide individual medical advice directly to consumers.

3. Orders and acceptance

Orders may be placed by approved practitioner customers through the website, email, phone or other approved ordering channels.

Acceptance of an order is subject to account approval, product availability, payment approval and any internal supply controls.

BlueSkyGreenEarth Herbs Pty Ltd may refuse, cancel or place an order on hold where account details cannot be verified, payment is not received, product is unavailable, or supply is considered inappropriate.

4. Pricing and payment

Prices are listed in Australian dollars unless otherwise stated.

Prices may change from time to time without prior notice.

Payment must be made using the approved payment methods available at the time of order.

5. Delivery

Delivery timeframes are estimates only and may vary depending on order processing, stock availability, courier delays or delivery location.

Risk in the products passes to the practitioner customer upon delivery to the nominated address, unless otherwise required by law.

6. Returns and damaged goods

Returns, credits or replacements are handled in accordance with Panaxea’s refund and return policy.

Practitioner customers should notify Panaxea promptly if products are received damaged, incorrect, expired, affected by temperature exposure, or otherwise unsuitable for supply.

Product quality concerns may also be handled as product complaints under the sponsor’s pharmacovigilance and quality processes.

7. Product information

Product information provided on panaxea.com.au is intended for qualified healthcare practitioners.

Product information should be considered together with product labels, ARTG-listed indications where applicable, practitioner assessment and professional judgement.

Practitioner customers must not use Panaxea product information to make claims that are inconsistent with the product label, ARTG entry, or applicable therapeutic goods advertising requirements.

8. Product safety reporting

Practitioner customers must promptly notify BlueSkyGreenEarth Herbs Pty Ltd of any adverse event, product complaint or other safety-related information relating to Panaxea products that they become aware of.

Notification should be made preferably within 1 business day of becoming aware of the information.

Safety-related information may include, but is not limited to:

  • suspected adverse events or side effects
  • nausea, vomiting, diarrhoea, stomach cramps, rash, dizziness, allergy or intolerance after product use
  • pregnancy or breastfeeding exposure concerns
  • suspected interactions or contraindication concerns
  • product quality complaints
  • packaging, labelling, batch or expiry concerns
  • unusual smell, taste, colour, texture or capsule/tablet appearance
  • incorrect product supplied
  • any serious, medically important or unexpected event

Incomplete information should still be reported.

9. How to report safety information

Practitioner customers should report adverse events, product complaints or safety-related information to:

Where available, please provide:

  • product name
  • AUST L number, if known
  • batch number and expiry date
  • patient initials, age and gender
  • description of the adverse event, product complaint or safety concern
  • date the product was started and stopped
  • dose taken
  • outcome / whether the patient has recovered
  • whether medical treatment or hospital care was required
  • reporter name, clinic and contact details

10. Sponsor management of safety information

BlueSkyGreenEarth Herbs Pty Ltd will review, record, assess and manage adverse events, product complaints and safety-related information in accordance with its pharmacovigilance procedures, including PV-SOP-001.

The sponsor’s QPPV-A / A-PVCP is responsible for pharmacovigilance assessment and TGA reporting decisions where required.

11. Practitioner acknowledgement

By maintaining a practitioner account, placing an order, accessing practitioner-only product information, or purchasing Panaxea products, the practitioner customer acknowledges and agrees to these Terms of Sale.

The practitioner customer also agrees to promptly forward any adverse event, product complaint or other safety-related information relating to Panaxea products to BlueSkyGreenEarth Herbs Pty Ltd.

12. Changes to these terms

BlueSkyGreenEarth Herbs Pty Ltd may update these Terms of Sale from time to time.

The current version will be available on panaxea.com.au.
